Abstract

This study analyses the legal regime of civil liability for damages derived from accidents involving motor vehicles, whether autonomous or not. The irruption of such vehicles into legal traffic is a novelty that Spanish legislation must address. The legitimation for compensation will correspond to the owner of the damaged assets, the injured party and, if applicable, to the relatives, to the legally predetermined relatives with presumptive character in the event of death. Compensation for damages shall follow the general system of valuation for pecuniary damage or the legal system of valuation for personal injury, without the injured party having to suffer a loss in this respect depending on whether or not the vehicle is an autonomous one. The liability, in the absence of a driver, by virtue of the pro damanato principle, prevailing in Spanish law, must fall on the owner of the vehicle, and his liability must be interpreted as strict liability, and on the insurance company or the Insurance Compensation Consortium, as the case may be. If the loss was due to the defective nature of the vehicle, in any of its facets, the owner could claim against the manufacturer.

Law on Civil Liability and Insurance in the Circulation of Motor Vehicles (Ley de Responsabilidad Civil y Seguro en la Circulación de Vehículo de Motor): Article 1. Civil liability.

1. El conductor de vehículos a motor es responsable, en virtud del riesgo creado por la conducción de estos, de los daños causados a las personas o en los bienes con motivo de la circulación.

En el caso de daños a las personas, de esta responsabilidad sólo quedará exonerado cuando pruebe que los daños fueron debidos a la culpa exclusiva del perjudicado o a fuerza mayor extraña a la conducción o al funcionamiento del vehículo; no se considerarán casos de fuerza mayor los defectos del vehículo ni la rotura o fallo de alguna de sus piezas o mecanismos.

En el caso de daños en los bienes, el conductor responderá frente a terceros cuando resulte civilmente responsable según lo establecido en los artículos 1.902 y siguientes del Código Civil, artículos 109 y siguientes del Código Penal, y según lo dispuesto en esta Ley.

For the purposes of this Act and its complementary provisions, the following definitions shall apply:

1. Driver. Person who, with the exceptions of the second paragraph of point 4, controls the steering mechanism or is in command of a vehicle, or in charge of an animal or animals. In the case of vehicles operated on a learner-driver basis, the person in charge of the additional controls shall be regarded as the driver.

Article 2. The obligation to obtain insurance. 1. Every owner of motor vehicles normally based in Spain shall be obliged to take out and maintain in force a contract of insurance for each vehicle he owns, covering, up to the amount of the limits of compulsory insurance, the civil liability referred to in Article 1. However, the owner shall be relieved of this obligation when the insurance is concluded by any person who has an interest in the insurance, who must state the concept in which he is contracting.
